PROPERTY SETTLEMENT
Our Brisbane Family Lawyers can assist parties to come to a fair and equitable agreement in relation to financial matters and issues between them arising from the breakdown of a relationship including the division of assets and liabilities, spousal maintenance, superannuation and child support. Those arrangements can be formalised by way of Consent Orders or in a Binding Financial Agreement under the Family Law Act 1975 (Cth).
parenting dispute
Many relationship breakdowns involve children which often leaves the question of who the children will 'spend time with' or 'live with' post-separation. In all child custody matters, the paramount consideration is the the “child’s best interests”. Disputes concerning children are often resolved by drafting a parenting plan or minutes of consent which are then submitted to the court and formalised into court orders.
DIVORCE
Divorce is the legal dissolution of a marriage by a Court. It is not an all encompassing application and is separate to matters such as parenting, property division and/or maintenance. In Australia, we have a no fault divorce system. Neither party is required to prove that the other party was at fault and there does not need to be an agreement between the parties to initiate proceedings. The divorce process is designed to be relatively easy and straightforward, however complications can arise. It is always best to speak with a divorce lawyer.
Domestic Violence
Our Domestic Violence Lawyers are experienced in dealing with issues of domestic violence or family violence and the sensitivities of protecting and defending clients against what can be a difficult dynamic.
If you, a child or other family member are experiencing emotional, physical or economic abuse at the hands of a former partner you may be able to apply for a court order to protect your right to peace and quiet, undisturbed by threats to your wellbeing or your quality of life.
child support
Child support is a term used to describe the payment of money from one parent to the other for the purpose of helping that parent raise their child/ren who are under 18 years of age. All children in Australia whose parents have separated irrespective of whether or not the parents were married to each other are eligible for child support payments to support the financial costs associated with caring for a child.
spousal maintenance
Spouse maintenance is financial support paid by one party to their former partner where they are unable to adequately support themselves financially. Under the Family Law Act 1975 (Cth), a person has a responsibility to financially assist their spouse or former de facto partner if that person cannot meet their own reasonable expenses from their personal income or assets.
mediation
Our Brisbane Family Lawyers always encourage clients to mediate disputes. Mediation is a way of resolving disputes when people are in conflict which is facilitated by a neutral person. Separated families are encouraged to use family mediation to help resolve their disputes, instead of using the family law courts. If a dispute can be resolved through mediation it will also be significantly less expensive than having to go to court.
court representation
You can’t always pick your battles, but you can pick an experienced Family Lawyer to resolve your dispute through litigation. Our forward-thinking family law solicitors have a breadth of knowledge and expertise in providing strategic legal advice and formidable court representation. Seeking advice from our family lawyers can be the difference between the swift and efficient handling of a disagreement or drawn out litigation proceedings.
