child support explained
Child support is a term used to describe the payment of money from one parent to the other for the purpose of financially helping a parent to raise a child/ren who are under 18 years of age. All children in Australia whose parents have separated irrespective of whether or not those parents were married to each other are eligible for child support payments to support the financial costs associated with caring for a child/ren.
The breakdown of a family unit is a very difficult time for a child of a relationship. The children will inevitably be affected by big changes in care arrangements. At a traumatic time around separation, often immediate financial issues about the children such as school fees, fees for extra curricular activities, medical costs and the like are overlooked, only to become a big issue soon afterwards.
Our Brisbane Family Lawyers are able to deal with child support issues by drafing a child support agreement which can be an informal arrangement between parents or it can be formalised through a Limited Child Support Agreement or a Binding Child Support Agreement. Independent legal advice is required for both parties for a Binding Child Support Agreement.
The main benefit of reaching an agreement is that there is one less issue in dispute between parents at a difficult time. It also gives parents a degree of certainty so that they can make plans for the future. There are potentially disadvantages to an agreement such as not being able to take into account changed circumstances in the future so it is always best to obtain legal advice prior to entering into a child support agreement.
PARENTING / CHILDREN
Many relationship breakdowns involve children which often leaves the question - who will the child/ren live with or spend time post-separation? The paramount consideration in all disputes involving children is the concept of the “child’s best interests”. Disputes about children can be resolved by the drafting a parenting plan or by draft minutes of consent which are submitted to the court.
